1. Agreement to Terms
These Terms and Conditions (the “Terms”) govern your access to and use of www.tellurianresearch.com (the “Website”), including the content, blog articles, research reports, features, client areas, subscription services and other services made available through it (collectively, the “Services”).
The Website is operated by Tellurian Research W.L.L., a company incorporated in the Kingdom of Bahrain under Commercial Registration No. 198228-1, with an address at Suite 21, Sanabis, Kingdom of Bahrain.
By accessing or using the Website, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Website or Services.
2. Eligibility and Authority
You must be at least 18 years old and legally capable of entering into a binding agreement to use the Services. If you use the Website or Services on behalf of a company, government body, investment organisation or other entity, you represent that you have authority to bind that entity to these Terms.
The Website is intended primarily for professional, corporate, institutional and governmental audiences and is not directed to children.
3. The Services
The Website provides information about Tellurian, articles and commentary, and may provide sample materials, research reports, briefings, account functions, subscription services or a password-protected client area.
We may add, update, suspend, restrict or discontinue any part of the Website or Services. We will provide notice where required by applicable law or an existing client agreement, but we do not guarantee that any particular public feature or item of content will remain available.
A request for information, sample material or a proposal does not oblige Tellurian to accept an engagement or provide any service. Commissioned research, subscriptions, advisory work and other paid services may be governed by a separate proposal, order form, licence or client agreement. If such an agreement conflicts with these Terms, the separate agreement will govern the relevant service or deliverable.
4. Accounts and Client Areas
Where an account or client area is available, you agree to:
- provide accurate, current and complete registration information;
- keep login credentials confidential and use reasonable measures to protect them;
- not share credentials with an unauthorised person;
- accept responsibility for activity conducted through your account or systems under your control; and
- notify us promptly of suspected unauthorised access or use.
We may suspend, restrict or terminate account access where reasonably necessary to protect security, comply with law, investigate misuse, enforce these Terms or an applicable agreement, or protect Tellurian, its clients or third parties.
Access and usage rights are limited to the authorised users and organisation identified in the applicable subscription, order form or client agreement. Reports and restricted materials may not be transferred, resold, redistributed or made available to any other person or organisation except as expressly permitted in writing.
5. Subscriptions, Payments and Cancellation
Where paid subscriptions or digital materials are offered through the Website, the applicable fees, currency, billing cycle, included access, authorised users, renewal terms, cancellation process and any specific refund terms will be displayed before purchase or set out in an order form or client agreement.
Unless otherwise stated, fees are payable in advance and exclusive of applicable taxes. Automatic renewal will apply only where it has been clearly disclosed and authorised. A subscriber may cancel a future renewal in the manner stated at purchase or by contacting us before the applicable renewal deadline. Unless the applicable terms state otherwise, cancellation stops future renewal and access continues until the end of the current paid period.
Except where required by applicable law or expressly provided in the terms displayed at purchase, an order form or a client agreement, fees are non-refundable once access to the relevant digital content or subscription period has begun. We may suspend access following failed, reversed or overdue payment. Payments may be processed by a third-party provider whose terms and privacy practices also apply.
Nothing in this Section limits any mandatory consumer or statutory rights that cannot lawfully be excluded. Where services are purchased under a negotiated business-to-business agreement, that agreement governs pricing, invoicing, renewal, cancellation and refunds.
6. Research Content – Important Disclaimer
Research reports, articles, briefings, commentary and other content are provided for general informational purposes unless a separate written agreement expressly states otherwise. They reflect Tellurian’s analysis, opinions and professional judgement as at the stated date and may change without notice.
Certain Reports and content are produced or assisted by artificial-intelligence (“AI”) systems. While Tellurian takes reasonable steps to review and validate AI-assisted output, AI systems can generate errors, omissions or inaccuracies, including content that appears plausible but is incorrect. Tellurian does not warrant that AI-assisted content is accurate, complete or current, and you should independently verify any information before relying on it.
Tellurian’s research may draw on public sources, commercial databases, technology-assisted analysis, geospatial or satellite information, local and regional sources, third-party information and expert assessment. Information concerning companies, markets, political developments, security conditions, regulation, infrastructure and natural-resource operations may be incomplete, delayed, disputed, confidential, rapidly changing or difficult to verify independently. Assessments, estimates, forecasts and forward-looking statements involve uncertainty, and Tellurian does not guarantee that content is complete, current or accurate in every respect.
Nothing on the Website constitutes investment, financial, legal, tax, accounting, regulatory or other professional advice, or an offer, solicitation or recommendation to buy, sell or hold any security, commodity, asset, financial instrument or product. You should conduct your own assessment and obtain appropriate independent advice before making any decision. Use of the Website does not create a client, advisory, fiduciary or other professional relationship with Tellurian.
7. Intellectual Property and Licence
The Website and its content are owned by or licensed to Tellurian and are protected by applicable copyright, trademark and other intellectual-property laws. Protected materials include text, reports, articles, research summaries, graphics, maps, photographs, data visualisations, methodologies, analytical frameworks, databases, logos, branding, software, layout and compilations.
Subject to these Terms, you are granted a limited, revocable, non-exclusive and non-transferable licence to access and view public Website content for lawful personal or internal business purposes. You may print or download a reasonable number of public pages for internal reference, provided that you do not modify the material, remove notices, distribute it externally, use it commercially or imply Tellurian’s endorsement.
Research reports, subscription materials and client-area content may be used only by the authorised users and organisation, and only for the internal purposes permitted by the applicable subscription, order form or client agreement. No ownership or broader licence is transferred. Any reproduction, republication, distribution, resale, sublicensing, public display or commercial exploitation requires our prior written consent.
“Tellurian Research”, the Tellurian name, logos and associated branding are trademarks or trade identifiers of Tellurian or its licensors. No right to use them is granted except with prior written permission.
8. Acceptable Use
You must not:
- use the Website or Services in breach of applicable law, regulation, sanctions, export-control or third-party rights;
- attempt to gain unauthorised access to any account, client area, server, database, network or system;
- introduce viruses, malware, harmful code or disruptive technology;
- interfere with the security, integrity, availability or performance of the Website or another user’s access;
- use bots, crawlers, scraping tools or other automated means to extract, monitor, harvest or copy content without our prior written consent;
- use any content, report, dataset or other material obtained through the Services to train, test, validate or improve an artificial-intelligence model, machine-learning system, database or competing research product without our prior written consent;
- remove or alter copyright, trademark, confidentiality, attribution or proprietary notices;
- circumvent access controls, usage restrictions, subscription limits or security measures;
- misrepresent your identity, organisation, authority or relationship with Tellurian;
- submit false, misleading, defamatory, unlawful or infringing material; or
- use Tellurian content in a misleading manner, outside its context, or in a way that suggests an unauthorised partnership, sponsorship or endorsement.
9. Information Submitted to Tellurian
When you submit an enquiry, request, document or other material through the Website, you represent that the information is accurate to the best of your knowledge, that you are authorised to provide it, and that its submission does not violate confidentiality, privacy, intellectual-property or other rights. We may use the information for the purpose for which it was submitted and as described in our Privacy Policy.
Do not send confidential, classified, privileged, export-controlled or highly sensitive information through the public Website unless Tellurian has expressly agreed to receive it through an approved secure channel. Submitting information through the Website does not create a confidential, fiduciary or client relationship unless Tellurian expressly agrees otherwise in writing.
10. Third-Party Links and Services
The Website may contain links or references to third-party websites, publications, data, products or services. They are provided for convenience and context. Tellurian does not control and is not responsible for third-party content, availability, security, accuracy, privacy practices or terms. A link or reference does not necessarily constitute endorsement, verification or approval.
11. Website Availability and Changes
We do not guarantee that the Website or any public feature will always be available, uninterrupted, secure or error-free, that defects will be corrected immediately, or that content will remain available for any particular period. You are responsible for maintaining appropriate security software, systems and backups.
12. Disclaimer of Warranties
To the fullest extent permitted by law, the Website, Services and content are provided on an “as is” and “as available” basis. Tellurian disclaims all express, implied and statutory warranties, including warranties of accuracy, completeness, timeliness, merchantability, fitness for a particular purpose, non-infringement, security and uninterrupted availability. Nothing in these Terms excludes a warranty or obligation that cannot lawfully be excluded.
13. Limitation of Liability
To the fullest extent permitted by applicable law, Tellurian and its affiliates, directors, officers, employees, consultants, agents and licensors will not be liable for indirect, incidental, special, exemplary, punitive or consequential loss, or for loss of profits, revenue, business, contracts, opportunity, anticipated savings, data, goodwill, reputation or investment value, arising out of or in connection with the Website, Services, content, third-party services or any decision made in reliance on them.
Where liability cannot lawfully be excluded and no separate client agreement provides a different limitation, Tellurian’s total aggregate liability arising out of or relating to these Terms or the Services will not exceed the greater of (a) BHD 100 and (b) the amount paid by you to Tellurian for the relevant Services during the twelve months preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, wilful misconduct, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited.
14. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Tellurian and its affiliates, directors, officers, employees, consultants, agents and licensors from claims, liabilities, damages, losses and reasonable legal costs arising from your unlawful use of the Website or Services, material breach of these Terms, unauthorised distribution or misuse of content, information you submit, or infringement of another person’s rights. This Section does not apply to the extent a claim results directly from Tellurian’s own unlawful conduct.
15. Suspension and Termination
We may suspend, restrict or terminate your access where you breach these Terms or an applicable agreement, access creates a security or legal risk, payment is overdue, we are required to act by law or a competent authority, or continued access may harm Tellurian, a client, a source or another party.
On termination, your right to access the affected Services ends immediately, subject to any applicable client agreement. Provisions intended by their nature to survive termination, including intellectual property, disclaimers, liability limitations, indemnification and governing law, will continue to apply.
16. Privacy
Our processing of personal data in connection with the Website and Services is described in our Privacy Policy. You should read the Privacy Policy together with these Terms.
17. Changes to These Terms
We may revise these Terms from time to time. Changes affecting general use of the public Website will take effect when posted with an updated “Last updated” date. Where a material change affects an existing paid subscription, we will provide reasonable notice and the change will ordinarily take effect at the next renewal unless earlier application is required by law, security considerations or the applicable client agreement. Continued use after a change takes effect constitutes acceptance to the extent permitted by law.
18. Governing Law and Jurisdiction
These Terms and any non-contractual obligations arising from them are governed by the laws of the Kingdom of Bahrain, without regard to conflict-of-law principles. Subject to any mandatory rights or jurisdictional requirements that cannot lawfully be excluded, the courts of the Kingdom of Bahrain will have exclusive jurisdiction over disputes arising from or relating to the Website, Services or these Terms.
19. General Provisions
If any provision of these Terms is held to be invalid or unenforceable, it will be modified to the minimum extent necessary or removed, and the remaining provisions will continue in effect. A failure or delay in enforcing a provision does not constitute a waiver.
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. Tellurian may assign or transfer its rights and obligations in connection with a restructuring, merger, financing, sale or transfer of all or part of its business.
Communications, notices, acceptances and records may be provided or maintained electronically to the extent permitted by law. Headings are for convenience and do not affect interpretation.
These Terms, together with the Privacy Policy and any additional terms expressly presented for a particular Service, constitute the agreement governing use of the public Website. A separate subscription, order form, licence or client agreement will govern the relevant paid service where applicable.
